Wills

A will is one of the most important documents any individual can create during his or her life.  It controls the disposition of your property, determines who will administer your estate and the caretaker of your children.  If you die without a will New York State law will determine all of these things.  Nevertheless, many Americans either do not have a will or have attempted to create a will without the assistance of an attorney using “boiler plate” forms or drafting a will wholly on their own.  Both these methods are highly inadvisable because there are legal consequences lay individuals do not anticipate and “boiler plate” forms do not account for individualized needs.  Schwartz & Sinski will provide you with competent advice tailored to your own needs allowing you to rest assured that your wishes will be carried out upon your death.

Some examples of what will happen should you die without a will leaving:

  • a spouse and descendants, your spouse will receive $50,000 “off the top” of the estate.  Then your spouse will receive one half the balance of the estate leaving the other half to be shared
  • a spouse and no descendants your spouse will receive your entire estate. 
  • descendants and no spouse, your descendants will take all. 
  • one or both parents, no spouse and no descendants: your parent or parents will receive the entire estate
  • descendant’s of your parents and no closer relatives, the descendant’s of your parents take all
